EPA Exceeds Statutory Authority in PFAS Fluorination Case

The U.S. Court of Appeals for the Fifth Circuit ruled on a petition filed by Inhance Technologies LLC against the U.S. Environmental Protection Agency (EPA). 

The Fifth Circuit decided that "EPA exceeded its statutory authority" under Section 5 of the Toxic Substances Control Act when it issued orders seeking to prevent Inhance from manufacturing or processing, certain per- and polyfluoroalkyl substances (PFAS).
